Terms and conditions

These terms govern access to Inca Trail Company’s editorial guides, availability tools, comparisons, external links and contact services.

Acceptance and scope

By accessing or using incatrailcompany.com, you agree to these terms and our privacy policy. If you do not agree, do not use the website’s interactive or contact services.

The website is operated under the name Inca Trail Company from Cusco, Peru. These terms apply only to this website. A tour operator, booking platform, government service or other linked organization has separate terms that you must review before dealing with it.

You must have legal capacity to submit commercial inquiries or enter agreements. A minor may use general educational content only with appropriate supervision and must not submit personal data without authorization from a parent or legal representative.

Our role: information, not tour operation

Inca Trail Company is an independent travel-information and technology platform. We are not a tour operator, travel agency, guide employer or government authority. We do not issue Inca Trail permits, reserve places, collect trek payments or provide transport, accommodation, guiding, porter, food, medical or emergency services.

A booking, payment, cancellation, refund, itinerary, insurance or emergency-support relationship is between the traveler and the selected third-party provider under that provider’s current terms. A link, listing or comparison on this website does not make us an agent, partner or guarantor of that provider.

Inca Trail Company is not affiliated with or endorsed by Peru’s Ministry of Culture, SERNANP, PromPerú or another public authority unless a specific page expressly says otherwise.

Editorial information and availability

We aim to publish clear, sourced and current information. Nevertheless, permits, regulations, routes, closures, weather, prices, inclusions, operator authorization and government systems can change without notice. A “reviewed” or “updated” date records our editorial check; it does not guarantee that every fact remains current when you act on it.

Verify time-sensitive facts with the competent authority and obtain all booking terms from the selected provider before paying. If an official source conflicts with this website, follow the current official instruction.

Availability checker

Availability shown on this site is a planning aid obtained from a third-party data service. Results may be delayed, incomplete or change while another request is processed. A displayed space is not reserved, held or sold to you. Only an authorized provider can confirm in writing that the correct permit and related services have been secured for the correct traveler, route and date.

We may change, suspend or discontinue a page, checker, API or other feature for maintenance, security, data-quality or business reasons.

Third-party services and commercial relationships

External links, operator profiles, prices and product examples lead to independent organizations. We do not control their websites, availability, cybersecurity, legal compliance, financial condition or service delivery. Inclusion is not government authorization, endorsement or a guarantee of safety or quality.

Check the legal name of the company receiving payment, its authorization, complete itinerary, refund and cancellation terms, insurance requirements and emergency arrangements. Complaints about an existing reservation should first be directed to the provider named in the confirmation.

We may receive a commission when a user follows a clearly disclosed referral link and completes a transaction with a third party. We may also sell availability data, widgets or related technology to tourism businesses. A commercial relationship does not purchase a favorable editorial conclusion, ranking or immunity from a factual correction. Our editorial methodology explains these safeguards.

Third-party trademarks and names are used for identification and comparison. Their appearance does not imply ownership, affiliation or endorsement.

Health, safety and travel risk

Travel and trekking in the Andes involve altitude, exertion, isolation, changing weather, uneven terrain, transport disruption and other inherent risks. Conditions and individual responses vary.

Health, training, equipment, altitude and safety content on this website is general education, not individual medical advice, diagnosis, treatment, emergency instruction or a fitness assessment. Consult an appropriately qualified medical professional about your circumstances and discuss route-specific safety, staffing and evacuation procedures with the selected operator.

In an emergency or conflict with current instructions, follow local authorities, emergency services and qualified professionals rather than this website. Never delay urgent care because of something published here.

Messages, corrections and contributions

Do not send confidential client records, passport details, payment data, medical information, trade secrets or content you are not authorized to share. Contact-form and email submissions are handled as described in our privacy policy, but ordinary email cannot be guaranteed confidential.

You retain ownership of original material you submit. When you ask us to evaluate text, photographs, data or another contribution for publication, you confirm that you have the necessary rights and grant us a non-exclusive, worldwide, royalty-free license to review, edit, reproduce and publish the accepted material on this website and in directly related promotional formats. This license applies only to material actually accepted for those purposes; contact us before submission if different terms are required.

We may verify, edit, reject, unpublish or correct a submission. Submission does not guarantee publication, payment, attribution in a particular format, a listing, preferred placement or a business relationship. We will disclose a contributor’s relevant commercial relationship when appropriate.

Acceptable use

You may use the site for personal travel research, classroom reference, journalistic research and legitimate professional evaluation. You must not:

  • Attempt to bypass session, token, rate-limit, authentication or other access controls.
  • Probe for vulnerabilities, introduce malicious code or interfere with the website, hosting, APIs or another user.
  • Send spam, fraudulent inquiries, impersonations, unlawful material or content that infringes another person’s rights.
  • Harvest contact details or personal data, or use the site to build an unsolicited-marketing list.
  • Republish substantial portions of the website as your own guide, database, feed, AI dataset or commercial product without permission.
  • Use automated access in a way that ignores published crawler controls, creates unreasonable load or circumvents a technical restriction.
  • Misrepresent Inca Trail Company as a tour operator, government authority or endorser of a service.

We may restrict access, preserve relevant evidence and report conduct that threatens the site, users or third parties. A restriction does not limit any other remedy available under law.

Content and intellectual property

Unless a credit or source states otherwise, original text, design, code, graphics, maps and editorial organization on this website belong to Inca Trail Company or are used with permission. Third-party photographs, trademarks, official documents, data and quoted material remain subject to their respective rights and licenses.

You may link to public pages, print a reasonable copy for personal use and quote brief portions with clear attribution and a link to the relevant page. No permission is granted to remove credits, imply endorsement, sell copies, reproduce a substantial part of the site or reuse images, maps, data feeds or code independently of the page where they appear.

Requests for syndication, image licensing, data access or broader reuse can be sent to info@incatrailcompany.com.

Disclaimers and limitation of liability

The website is provided on an “as available” basis. To the extent permitted by applicable law, we do not guarantee uninterrupted access, an error-free service, the accuracy of third-party data, permit availability, a particular route or weather condition, or the performance, solvency, safety or legality of a third-party provider.

To the extent permitted by law, Inca Trail Company is not responsible for a loss caused by a third-party booking or payment, provider act or omission, route closure, government decision, weather event, illness, injury, transport disruption, expired information, external website or use contrary to these terms.

Nothing in these terms excludes liability for fraud, willful misconduct or another liability that cannot legally be excluded. Nothing restricts mandatory consumer, privacy or other statutory rights that apply to you. You remain responsible for independently verifying material travel and purchasing decisions.

Changes, governing law and general terms

Changes

We may update these terms when the website, business model or law changes. Updated terms apply from the effective date displayed on this page. Changes do not retroactively alter a separate agreement already signed with us.

Governing law and disputes

These terms are governed by the laws of Peru. Before starting formal proceedings, please send a clear description of the issue so it can be reviewed in good faith. Subject to mandatory rights and jurisdiction rules that cannot be waived, disputes relating solely to this website will be submitted to the competent courts of Cusco, Peru.

Severability and no waiver

If a provision is held invalid or unenforceable, it will be applied to the maximum lawful extent and the remaining provisions will continue in effect. A delay in enforcing a provision does not waive it. These terms and the privacy policy form the general agreement governing use of the public website; a separately signed service agreement controls where it expressly conflicts.

Contact

Questions about these terms, content permissions and correction notices can be sent to info@incatrailcompany.com. Commercial technology inquiries can be sent to agencies@incatrailcompany.com.
